The agreement between you and VoiceGun, including what you are responsible for when we place calls or send messages for you.

These terms are between you and APPWRK IT Solutions LLC ("VoiceGun", "we", "us"), registered at 30 North Gould Street, STE R, Sheridan, WY 82801, United States, with offices at 101 First Floor, WORLD TECH 67, ITC 10, Near Municipal Building, Sector 67, SAS Nagar, Mohali, Punjab 160062, India and 1242, 447 Broadway, 2nd Floor, New York, NY, United States. By creating an account, using the platform, or requesting a test call from this website, you accept them. If you are agreeing on behalf of a company, you confirm you have authority to bind it.
VoiceGun provides AI voice agents that make outbound calls and answer inbound ones, along with related messaging, including WhatsApp messages sent to recipients who have asked to receive them. Features change over time. We may add, alter or withdraw functionality, and will give reasonable notice before removing something you depend on.
You are responsible for the accuracy of your account details, for keeping credentials secure, and for everything done through your account. Tell us promptly if you think it has been compromised. You must be at least 18 and legally able to enter a contract.
This is the most important section of these terms. VoiceGun is the instrument; you decide who gets contacted. You are responsible for the lawfulness of that decision, and you confirm that for every contact you upload or every number you message:
Automated calling and messaging are regulated, and in several jurisdictions penalties attach per call or per message. Configuration errors therefore scale. We provide disclosure, suppression, calling-window and consent tooling, and we expect it to be used, but we do not and cannot verify the lawfulness of your contact list.

We may suspend an account immediately where we reasonably believe this section is being breached, or where a carrier, regulator or Meta requires it.
Paid plans are billed as set out in your order or on our pricing page, usually on connected minutes. Fees exclude taxes unless stated. Late payment may lead to suspension. Except where the law says otherwise, fees already paid are not refundable.
You keep ownership of the contact data you upload and of the recordings and transcripts your calls generate. You grant us the licence needed to run the service for you. We keep ownership of the platform, the software and our brand. Nothing here transfers our intellectual property to you.
Personal data is handled as described in our Privacy Policy. Where we process your contacts' data on your behalf, we do so on your instructions as a processor.
We aim for high availability but do not promise the service will be uninterrupted or error-free. Telephony depends on carriers we do not control, and WhatsApp delivery depends on Meta. Maintenance may require downtime, and we will give notice where we reasonably can.
AI voice agents are probabilistic. Speech recognition is good and not perfect, and an agent can misunderstand or produce an inaccurate response. Do not use VoiceGun as the sole basis for a decision with legal, financial or medical consequences for a person. Judgement calls, including negotiation, hardship and dispute handling, belong with trained people.
To the extent the law allows, the service is provided "as is" and we exclude all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant any particular contact rate, conversion rate or business outcome.
To the extent the law allows, neither party is liable for indirect, incidental, special or consequential loss, or for lost profits, revenue or data. Our total liability arising out of these terms is limited to the fees you paid us in the 12 months before the claim arose.
Nothing in these terms limits liability that cannot be limited by law, and this section does not limit your liability under section 4 or your indemnity under section 12.
You will indemnify us against claims, penalties and reasonable costs arising from your use of the service in breach of these terms, and in particular from calls or messages sent to people you did not have a lawful basis to contact.
You may close your account at any time. We may terminate or suspend for material breach, for non-payment, or where required by a regulator, carrier or Meta. On termination your right to use the service stops, and you can export your data for 30 days, after which we delete it in line with the Privacy Policy.
We may update these terms. Material changes will be notified to account holders by email before they take effect. Continuing to use the service after that means you accept the new version.
These terms are governed by the laws of the State of Wyoming, United States, and the parties submit to the exclusive jurisdiction of the courts of the State of Wyoming, United States.
